If you use the Service on behalf of an organization, you bind that organization.Eligibility: You must be at least 18 and able to form a binding contract. By accessing or using any OITH website, mobile app, web app, or related service (collectively, the "Service"), you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Service.If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and "you" includes the organization.These Terms incorporate by reference the following, which you also agree to (to the extent applicable): Privacy Policy, Cookie Policy, Community Guidelines, Safety Tips (or Safety Guidelines), and Data Deletion instructions.

3. Eligibility (Adults Only)
You must be at least 18 years old (or the age of majority where you live, whichever is higher) and able to form a binding contract. You may not use the Service if you are prohibited by law, required to register as a sex offender, or subject to legal restrictions that would make your use unlawful. We may terminate accounts that present elevated safety or legal risk, consistent with applicable law.
4. Account Registration, Security, and Restrictions
Provide accurate, current information and keep it updated.Keep credentials confidential and notify us of suspected unauthorized access.One account per person unless expressly authorized.Do not impersonate others or use images you lack permission to use.We may limit devices/sessions and require verification to reduce abuse.
5. The Service; No Guarantee of Outcomes; Modifying and Discontinuing the Service
OITH is a dating platform that may include matching, messaging, timers, date-planning tools, safety features, and paid upgrades. We do not guarantee matches, responses, dates, or relationship outcomes. The Service is not a professional service (medical, legal, mental health, security, or background checking).We may change, limit, or discontinue features or the Service at any time. We have no obligation to maintain or provide any particular functionality. We will use reasonable efforts to give notice where required by law or where practicable for material changes.
6. Safety; Offline Interactions; No Background Checks; Assumption of Risk; Release
No criminal background checks. OITH does not conduct criminal background checks on users. Unless we state otherwise in writing, we do not verify identity, intent, or profile accuracy.Not responsible for user conduct. We are not responsible for the conduct of any user on or off the Service, including in-person meetings.Your responsibility. You are responsible for your safety and your interactions with other users, including in-person meetings. Safety guidance (e.g., meet in public, arrange your own transportation, avoid sharing financial information, report suspicious conduct) is provided for convenience. You should use common sense. The Service is not an emergency service.Assumption of risk. You acknowledge and assume the risks of online and offline dating, including harassment, fraud, assault, misrepresentation, and other harm. Online and offline dating carry inherent risks that we cannot eliminate.Release. To the maximum extent permitted by law, you release OITH and its affiliates from any and all claims arising from your interactions with other users, user content, or meetings arranged through the Service. If you are a California resident, you waive Civil Code Section 1542 to the extent applicable (with respect to unknown claims that might otherwise limit the scope of this release).
7. Community Standards; Prohibited Conduct
You must comply with our Community Guidelines and Safety Guidelines (if any). Prohibited conduct includes harassment, hate speech, sexual exploitation of minors, non-consensual sexual content, fraud or solicitation, trafficking or illegal services, doxxing or extortion, unauthorized data access, scraping, reverse engineering, automation/bot use, and evasion of safety or enforcement measures.
8. Reporting, Moderation, and Enforcement
We may provide reporting and blocking tools. We may (but are not required to) review content, investigate reports, and take enforcement action (warnings, removals, suspensions, bans, device restrictions, law enforcement referrals). We may use automated tools, which can make mistakes. We do not guarantee enforcement outcomes.
9. Matching, Timers, and Algorithmic Features
The Service may use matching limits, decision windows, connection timers, expirations, or auto-actions. Compatibility scores and recommendations (including date ideas) are informational only and not guarantees of chemistry, safety, or intent. Algorithmic systems may evolve and have limitations.
10. User Content and Messaging
"User Content" includes profiles, messages, photos, and date requests/responses. You are responsible for your content and warrant you have the rights to post it.You grant OITH a non-exclusive, worldwide, royalty-free, sublicensable license to host, store, reproduce, process, adapt, display, and distribute your content as needed to operate, improve, and secure the Service and enforce these Terms.Messaging may be delayed, duplicated, or fail; we do not guarantee delivery or read receipts. Other users may capture or re-share your content. Do not send sensitive financial or confidential information through the Service.
11. Paid Features, Billing, and Refunds
Paid features and pricing will be disclosed at purchase. For web billing, third-party processor terms apply. Subscriptions may auto-renew unless canceled before the billing period ends. Refunds are not guaranteed unless required by law. We may change prices or plans with notice where required. We may suspend accounts tied to fraud or chargeback abuse.
11a. External Service Purchases (Apple, Google, etc.)
Purchases made through Apple App Store, Google Play, or any other external platform are subject to that platform's terms. Billing, refunds, cancellation, and subscription management for such purchases are governed solely by the platform. OITH is not responsible for those platforms' policies, actions, or failures. Contact the respective platform for billing or refund requests.
12. Third-Party Services and Content
The Service may link to or integrate with third parties (app stores, maps/places, payment processors, analytics, email providers). We do not control them and are not responsible for their content or performance. Third-party data may be inaccurate or incomplete; verify independently.
13. Intellectual Property; License to Use the Service
The Service and our content (software, designs, trademarks, logos, and features) are owned by OITH or its licensors. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, or create derivative works without permission, except as allowed by law. Feedback may be used without restriction or compensation.
14. Privacy

15. Termination
You may stop using the Service at any time. We may suspend or terminate access for violations, suspected fraud/abuse, safety risks, or legal compliance. Data may be retained for legal, safety, or backup reasons.
16. Disclaimers
To the maximum extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free service, the accuracy or reliability of user-generated content, or user safety, identity, or intent.
17. Limitation of Liability
To the maximum extent permitted by law, OITH and its affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of profits, data, use, goodwill, reputation, or other intangible losses. We are not liable for damages arising from: the conduct of any user; interactions between users; in-person meetings; reliance on profiles, matching, or recommendations; or unauthorized use, capture, or re-sharing of your content.Our total liability for any claim will not exceed the greater of (a) the amount you paid to OITH in the 12 months before the event giving rise to the claim, or (b) $100.Some jurisdictions limit these exclusions or caps; they apply to the maximum extent permitted.
18. Indemnification
You agree to defend, indemnify, and hold harmless OITH and its affiliates from claims and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, your interactions with others, or your violation of these Terms or applicable law.
19. Dispute Resolution; Arbitration; Class Action and Jury Waiver
Informal process first. Before initiating arbitration, you must contact us at [email protected]
and attempt to resolve the dispute informally. We will make a good-faith effort to resolve it within 60 days. If the dispute is not resolved, you may proceed to arbitration or small claims as set out below.Binding individual arbitration. Except as set out below, any dispute that is not resolved informally will be resolved by binding individual arbitration, not in court and not as a class or representative action.Small claims. You may bring an eligible claim in small claims court in your jurisdiction if it is within that court's jurisdiction.Sexual assault and sexual harassment (EFAA). Individual claims of sexual assault or sexual harassment that occurred in connection with the Service are exempt from the mandatory arbitration requirement. You may choose to bring such a claim in court or in arbitration.Class action and jury waiver. You waive the right to participate in a class action, class-wide arbitration, or other representative proceeding. You waive the right to a jury trial.Opt-out of arbitration. These Terms are governed by the laws of the State of California, excluding conflict-of-laws rules, except where mandatory local law applies.

22. Special Terms (California and Other Jurisdictions)
California. If you are a California resident and a new subscriber, you may cancel your subscription without penalty within three (3) business days of the date you subscribed. For complaints or to report issues, you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs.
23. Miscellaneous
We may update these Terms with notice where required by law. Continued use after changes may constitute acceptance.
